Terms

The term ‘Bukawa’ and ‘BukawaSwim’ refers to the company BukawaSwim which owns and operates the websites accessed via the domain name bukawaswim.com including all subdomains and all domains which redirect to the above website.

Special Offers

BukawaSwim reserves the right to withdraw or modify special offers at any time. All products are sold on a first come first served basis and no further discounts may be applied. When free shipping is offered, we reserve the right to send via the most economical service.

Refunds

If after we have accepted your order, or after you have received your order, and you wish to withdraw from the contract, you may do so by communicating that wish to us within 14 days of receiving the goods (providing the product is not ‘custom made’ or ‘customised’). If you have already received the goods and they are unwanted, you must return the goods to us at your own cost and risk. Provided the goods are returned in the same condition as we supplied them to you, you may return them for a full refund.

Faulty Goods

If goods do not reach you in good condition, are significantly different to as advertised or are faulty, please contact us to arrange replacement. Shipping costs for the affected portion of delivery back to BukawaSwim is at our expense. We will aim to acknowledge your complaint within 5 days and we will keep you informed about progress. BukawaSwim will only credit you for the items that have been damaged or are faulty upon safe return of the goods to us. We must be notified of damaged or faulty goods within 7 days of receipt. BukawaSwim will accept returns and give full refunds only in circumstances where the products have not been tampered with, worn or ‘used’ in any fashion. Your payment will be refunded within 14 days of the agreement to refund.

Delivery

Delivery will be made within the time frame specified according to your selected delivery method. Delivery to more remote areas or abroad, may take slightly longer. BukawaSwim will endeavour to deliver to you within the specified time, however, there may be instances when we cannot deliver within this time. If we realise that we cannot deliver to you within that time, we shall alert you as soon as possible to try to arrange another suitable time frame for delivery. BukawaSwim cannot be held responsible if any item you have ordered is impounded by or has extra duty charged on it by your local customs and excise department, therefore we recommend that you check with the Customs and Excise Department before ordering from us. Please note that delivery times do not include order processing or item customisation times.

BukawaSwim cannot be held responsible for failing to meet estimated delivery deadlines through situations that arise outwith our control (for example if an item is lost in the post). In situations where this occurs, BukawaSwim will take appropriate action based on the level of insurance purchased. Deliveries sent without tracking or insurance will be subject to the postal service’s standard compensation procedures which may involve significant delays in receiving compensation, and or compensation below the total order value.

VAT & Customs Charges

All prices shown include all applicable VAT in Monaco / France only. Sales tax and import duty will need to be calculated on all orders from across the globe.

Currencies

All prices are shown in Euros €. Any currency conversion shown is an estimate only, and the actual charge will be made in Euros €. Due to this, the value shown in each currency other than Euros € may differ from the amount charged. The amount charged will depend on the chosen payment method’s rate of conversion and may include additional charges.

We make every effort to ensure that images displayed on our website are as accurate as possible but cannot guarantee an exact match to the product as displayed on your screen.

Data Protection

BukawaSwim conforms to the French Data Protection Act. Any information you provide is treated in strict confidence and is stored in a secure location. Termination

BukawaSwim reserves the right to abort access of our internet services if your behaviour is found to be discordant with these terms and conditions at any time.

Intellectual Property

No permission is given by BukawaSwim in respect of the reproduction or use for injurious or commercial purposes of any brand names, product names, designs and any other material shown on the BukawaSwim website in which intellectual property rights subsist. ALL RIGHTS RESERVED.
